PRIVACY POLICY

DEFINED TERMS


"Service" means yvetteferris.com and the products, sessions, downloads, payments, and emails offered through it. "Visitor" means a person browsing the Service. "User" means a Visitor who submits a form, requests a free guide, purchases a Paid Product, books a Session, subscribes to email, or submits a testimonial. "Paid Product" means Book Writing 101, Self-Publishing Guide, and Writing Guides. "Personal Information" means any information identifying a Visitor or User. "Business" means Yvette Ferris, operating as Yvette Ferris Coaching.

1. WHO WE ARE
Yvette Ferris operates the Service as a sole proprietor under the trade style Yvette Ferris Coaching. The Service provides Book Completion and Mindset Coaching, free lead magnet downloads, Paid Products, paid coaching sessions, the Diagnostic Session, and related email communications. The website is hosted on Wix.com, Inc. Transactions are processed through the Wix Payments service. The current authoritative Wix Payments terms are published at https://www.wix.com/about/terms-of-payments and are incorporated by reference.

2. PERSONAL INFORMATION WE COLLECT
Full name and email address
Appointment date and time for a booked Session
Identity verification information needed to confirm a testimonial submission
Payment details processed through the Wix Payments service. Full debit or credit card numbers are processed and held by the underlying payments processor and are not seen or stored by the Business
Email engagement such as opens, clicks, and form submissions through Kit
Website usage and technical information such as Internet Protocol address, browser type, device type, pages viewed, session duration, referral source, and general geographic information at the city or region level
The Service does not collect phone numbers, mailing addresses, job titles, usernames, passwords, social sign in data, precise GPS location, mobile device features, or push notification permissions. The Service does not intentionally collect Sensitive Personal Information.


3. PAID PRODUCTS
The Paid Products currently sold through the Service are Book Writing 101, Self-Publishing Guide, and Writing Guides. Each Paid Product is sold through Wix Payments and delivered as a downloadable PDF after payment is confirmed.

4. SOURCES
Personal Information is collected directly from the person who submits a form, books a Session, purchases a Paid Product, or submits a testimonial. The Service does not currently purchase or receive Personal Information from data brokers or other outside sources.


5. PURPOSES AND LAWFUL BASES
Deliver requested Services and fulfill paid obligations such as Paid Product delivery and Session booking. Lawful basis: performance of a contract.
Send requested free guides and transactional confirmations. Lawful basis: performance of a contract.
Send welcome sequences, newsletters, and program updates through Kit. Lawful basis: consent, recorded by Kit.
Measure website traffic in aggregate through Google Analytics. Lawful basis: legitimate interest balanced against Visitor rights.
Monitor search visibility through Google Search Console. Lawful basis: legitimate interest.
Host, maintain, secure, and operate the Service through Wix. Lawful basis: legitimate interest.
Publish testimonials submitted with consent. Lawful basis: consent.
Respond to inquiries and privacy requests. Lawful basis: legitimate interest and legal compliance.


6. COOKIES AND SIMILAR TECHNOLOGIES
Wix uses Cookies for core website functionality. Google Analytics uses Cookies and Similar Technologies to measure traffic in aggregate. Kit uses tracking pixels to measure email engagement. Read the full Cookie Policy on the Service.


7. SERVICE PROVIDERS
Kit, Inc. for email delivery, lead magnet delivery, Paid Product announcements, welcome sequences, newsletters, and engagement measurement
Wix.com, Inc. for hosting, infrastructure, and bookings
Google LLC for Google Analytics and Google Search Console

8. PAYMENT PROCESSOR
Paid Products and Sessions are charged through Wix Payments. Full debit or credit card numbers are not seen or stored by the Business. The current list of underlying payments processors and acquiring banks for United States accounts is published at https://www.wix.com/about/terms-of-payments. The Business does not select a single underlying processor; the processors used depend on the merchant region, the currency, and the payment method chosen by the User.


9. RETENTION
Email subscriber record: kept while the subscription is active, plus 24 months after the last activity, then deleted or anonymized
Booking record: kept for 7 years from the date of the Session for tax and accounting duties
Paid product order record: kept for 7 years from the date of the order for tax and accounting duties
Testimonial consent record: kept for the life of the published testimonial plus 24 months
Website usage logs in Google Analytics (GA4): kept for 14 months by default in GA4
Website usage logs in Wix hosting: kept according to the Wix log retention defaults


10. SECURITY
The Service is served over HTTPS and SSL through Wix. Access to Wix, Kit, and Google accounts is restricted to the Business and authorized support personnel. If a Personal Information breach occurs, the Business notifies affected Users without undue delay and, where the General Data Protection Regulation applies, notifies the relevant supervisory authority within 72 hours under Article 33 of the Regulation (EU) 2016/679.


11. EMAIL MARKETING
Marketing email is sent through Kit. Each message identifies the sender accurately, uses a truthful subject line, includes a valid physical postal address on request, contains an unsubscribe link, and honors unsubscribe requests within 10 business days per 16 CFR §316.5. The Business does not currently send marketing messages by Short Message Service.


12. TESTIMONIALS
If you submit a testimonial, you grant the Business a worldwide, royalty-free, non-exclusive license to publish, reproduce, distribute, and display your testimonial on yvetteferris.com, in email communications, and in related marketing materials. You confirm that the testimonial reflects your honest experience, that any material connection with the Business is disclosed, and that you are at least 18 years old. The publication form and context are clear and conspicuous per 16 CFR Part 255.

13. YOUR RIGHTS AND HOW TO USE THEM
13.1 GENERAL

You may email yvette@yvetteferris.com to ask about Personal Information associated with you, to correct it, to delete it where the law allows, to limit marketing, or to make a privacy complaint. The Business verifies the identity of the requester before acting.


13.2 CALIFORNIA
Where the California Consumer Privacy Act or the California Privacy Rights Act applies, California residents have the right to know, the right to delete, the right to correct, the right to opt out of sale or sharing, the right to limit use of Sensitive Personal Information, and the right to non-discrimination for exercising these rights. The Business does not sell Personal Information based on the supplied facts. The response window is 45 days, extendable to 90 days per California Civil Code §1798.130(a)(2).


13.3 GENERAL DATA PROTECTION REGULATION AND UK GENERAL DATA PROTECTION REGULATION
Where Regulation (EU) 2016/679 or the UK General Data Protection Regulation applies, rights include access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with a supervisory authority. The response window is one month, extendable by two further months for complex requests per Article 12(3).


13.4 DO NOT TRACK AND GLOBAL PRIVACY CONTROL
The Business honors browser-level Do Not Track and Global Privacy Control signals as opt-out instructions for sale or sharing where applicable.


13.5 AUTOMATED DECISION MAKING AND PROFILING
The Service does not use Personal Information for automated decision making that produces legal or similarly significant effects on a User.


13.6 INTERNATIONAL DATA TRANSFERS
Where Personal Information is transferred outside the European Economic Area or the United Kingdom, the Business relies on Standard Contractual Clauses or an adequacy decision per Chapter V of the Regulation.


14. CHILDREN
The Service is not directed to children and does not knowingly collect Personal Information from children. Where Regulation (EU) 2016/679 applies, the relevant age is 16 years unless Member State law provides a lower age between 13 and 16. Where the Children Online Privacy Protection Act applies, the relevant age is 13 years per 16 CFR §312.5. A parent or guardian may email yvette@yvetteferris.com to request removal.


15. BUSINESS CHANGES
If the Business is sold, merged, reorganized, or transfers the Service, Personal Information may be transferred as part of that transaction. The receiving party honors the rights described in this Privacy Policy.


16. CHANGES TO THIS PRIVACY POLICY
The Business may update this Privacy Policy when the Service, the tools used, or applicable laws change. The effective date at the top is updated accordingly.
