TERMS OF USE

DEFINED TERMS
"Service" means yvetteferris.com and the products, sessions, downloads, payments, and emails offered through it. "User" means a person accessing or using the Service. "Paid Product" means Book Writing 101, Self-Publishing Guide, and Writing Guides. "Session" means a Diagnostic Session or any other paid coaching session. "Business" means Yvette Ferris, operating as Yvette Ferris Coaching.
1. ACCEPTANCE
By accessing or using the Service, you agree to these Terms of Use. If you do not agree, do not use the Service.
2. BINDING EFFECT AND ASSIGNMENT
These Terms bind the parties and their permitted successors and assigns. The Business may assign these Terms to a buyer, successor, or assign in connection with a sale, merger, or reorganization. You may not assign these Terms without the prior written consent of the Business.
3. ACCEPTABLE USE
You agree to use the Service for lawful personal or business purposes. You agree not to:
Use the Service in violation of any applicable law or third-party right
Interfere with the operation of the Service or attempt unauthorized access
Introduce malicious code or harmful material
Impersonate any person or submit inaccurate information
Copy, resell, or redistribute Service materials except as expressly permitted
Use automated methods to access or extract Service content in a way that burdens or interferes with the Service
4. PAID PRODUCTS
The Paid Products are Book Writing 101, Self-Publishing Guide, and Writing Guides. Each Paid Product is delivered as a downloadable PDF after payment through Wix Payments. Sales of Paid Products are final. No refunds are provided. Paid Products are licensed for personal or internal use only and may not be resold or redistributed. 5. SESSIONS AND BOOKINGS
A Session is scheduled through the Wix Bookings feature on the Service. The following booking rules apply:
Sales of Sessions are final. No refunds are provided.
A scheduled Session may be rescheduled one time with at least 24 hours advance written notice.
Only one reschedule is allowed per scheduled Session.
A Session missed without 24 hours advance notice, or not rescheduled within the one reschedule allowance, is treated as completed.
Rescheduling requests should be sent to yvette@yvetteferris.com and are confirmed only after written acknowledgement from the Business
Refund rights required by applicable consumer law are preserved and override the no refunds term where in conflict.
6. TESTIMONIALS AND USER SUBMISSIONS
If you submit a testimonial or other content, you grant the Business a worldwide, royalty-free, non-exclusive license to publish, reproduce, distribute, and display that content on the Service, in email communications, and in related marketing materials. You represent that the content reflects your honest experience, that any material connection with the Business is disclosed, that you are at least 18 years old, and that you own or have the right to submit the content.
7. INTELLECTUAL PROPERTY
Service text, guides, worksheets, Paid Products, branding, and other materials are owned by or used with permission by the Business. No ownership rights are transferred by viewing, downloading, or purchasing a Paid Product. Paid Products are licensed for personal or internal use only. Because the Service does not host user-submitted content, no Digital Millennium Copyright Act designated agent is maintained at this time.
8. THIRD PARTY SERVICES
Service functions depend on Wix, Kit, Google Analytics, Google Search Console, and Wix Payments. Those providers operate under their own terms and privacy practices. The current Wix Payments terms are at https://www.wix.com/about/terms-of-payments
9. DISCLAIMER OF WARRANTIES
To the extent permitted by applicable law, the Service and general Service materials are provided without a promise that they will always be available, complete, current, accurate, secure, or error free. Any legally required warranties are not excluded.
10. LIMITATION OF LIABILITY
To the extent permitted by applicable law, the aggregate liability of the Business arising out of or related to the Service is capped at the greater of United States Dollars 100 or the amount you paid the Business in the 12 months before the claim. This cap does not apply to liability that cannot be limited as a matter of law, including liability for fraud, for death or personal injury caused by negligence, and for any liability that applicable consumer law does not allow to be reduced or waived.
11. INDEMNITY
You agree to indemnify and hold the Business harmless from claims arising out of your misuse of the Service, your unlawful conduct, or your infringement of any third-party right in content you submit.
12. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the United States and the state of the Business principal place of business, without regard to its conflict of laws principles. Venue for any dispute that is not resolved through the pathway in section 13 lies exclusively in the state and federal courts located at the principal place of business of the Business.
13. DISPUTE RESOLUTION PATH
Before filing a claim, the parties attempt in good faith to resolve any dispute through informal negotiation for at least 30 days after written notice. Either party may thereafter file a claim in small claims court for individual claims within the small claims court jurisdiction. Either party may thereafter elect arbitration through the American Arbitration Association or JAMS under their applicable consumer rules. In that event the parties waive the right to a jury trial and waive participation in any class action.
14. SEVERABILITY
If any provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision is replaced by an enforceable provision that most closely reflects the parties intent.
15. NO WAIVER
Failure by the Business to enforce any right under these Terms does not waive that right.
16. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Cookie Policy, Website Disclaimer, Accessibility Statement, and Additional Compliance Notices published on the Service, form the entire agreement between the parties about the Service.

Section headings are for convenience only and do not limit the scope of any section.
